A man is furious over an "unfair" £100 fine he received for crossing controversial yellow road markings after buying a McDonald's breakfast. The 53-year-old Midlands sales manager said he devoured his double sausage and egg McMuffin from the branch at Springfield Retail Park in Staffordshire after crossing some yellow markings to park up.

And it was turning around on those notorious 'keep clear' hatched yellow markings on a service road outside the restaurant that saw him hit in the pocket. He was not the first to fall foul of the markings - and now Kevin Bennett has called in lawyers in a bid to overturn the fine, and says he 'won't give up' until it is cancelled.

Kevin told StokeonTrentLive: "This is a retail park. Every man and his dog parks there.

"I turned into the area after exiting the drive-thru and then parked opposite Halfords for five minutes, just minding my own business. I bit into my double sausage and egg McMuffin and then got a call to say my dad was ready to be picked up and I had to go off again.

“I was in the car for less than five minutes. I wasn’t blocking any entrance.

"It seems very pitiful and unfair - no obstruction or anything. I’ve spoken to independent solicitors about this."

The Newcastle-under-Lyme man said: "I’ve been driving for many years, I’m quite clued up on the Highway Code. I’m not giving up.

"If I'd parked on double-yellow lines then more fool me. They’re fining people knowing they’ll just pay it. It can’t just be me.”

It comes after the case of a 33-year-old cabbie, Kamran Parvez. He also got a parking fine after stopping on the yellow markings for just 47 seconds.

The 33-year-old was hit with the penalty at the Springfield Retail Park branch. The car park operator claimed he had parked on yellow 'keep clear' markings near the entrance to the McDonald's car park.

Hope remains fine could be overturned

However, there is hope for Kevin yet. Kam managed to overturn the penalty after winning a second appeal.

He was able to prove that he had never parked on the 'keep clear' markings as the company had suggested. He said: "I was in there for 47 seconds, including the U-turn and including loading the customer into the vehicle.

"I was parked outside of the restricted area. The customer was already waiting on the roadside.


"They rejected my appeal and included a site map. In there, the area has a red line which goes all the way to the entrance of McDonald's. It's bigger than the area they've marked out on the road. I want the public to know.

"They told me it was because I had entered the marked area and I had parked there. But I wasn't parked within the 'keep clear' area, I parked out of that area."

The parking company iPark Services at the centre of the row declined to comment after being approached by StokeonTrentLive. McDonald's said the area where Kevin landed his fine was not its responsibility.
